1. Acceptance of Terms

By accessing our website at fitlandhq.com, downloading our mobile application, or becoming a member of FitlandHQ gym, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, please do not use our services.

FitlandHQ reserves the right to update these Terms at any time. Continued use of our services after changes constitutes your acceptance of the revised Terms.

2. Membership

• Memberships are personal and non-transferable.
• Members must be at least 16 years of age (those under 18 require parental consent).
• You are responsible for maintaining the confidentiality of your account credentials.
• FitlandHQ reserves the right to refuse or terminate membership for violation of these Terms or gym rules.
• Membership fees and terms are as stated in the pricing schedule at the time of sign-up.

3. Health & Safety

• You confirm that you are in suitable physical condition to participate in gym activities. If in doubt, consult a medical professional before beginning any exercise programme.
• FitlandHQ is not liable for injury or health complications arising from gym use. You use all facilities and participate in all activities at your own risk.
• Members must follow the instructions of staff and trainers at all times.
• Any pre-existing medical conditions that may affect your training should be disclosed to staff prior to use.
• Members are responsible for using equipment correctly and safely. Please ask staff for assistance if unsure.

4. Gym Rules & Conduct

• Re-rack all weights after use.
• Wipe down equipment after each use.
• Respect fellow members and staff at all times. Harassment of any kind will not be tolerated.
• Appropriate gym attire must be worn at all times.
• No food or outside beverages (water is permitted) in workout areas.
• Smoking and alcohol are strictly prohibited on the premises.
• Personal training or coaching by non-FitlandHQ staff is not permitted without prior written approval.
• Photography and video recording requires the consent of all individuals captured.

5. Payment & Cancellation

• Membership fees are payable in advance as per your chosen plan. Payments are non-refundable except where required by law.
• To cancel your membership, please provide written notice to admin@fitlandhq.com with at least 7 days' notice before your next billing cycle.
• FitlandHQ reserves the right to change pricing with 30 days' written notice to members.

6. Liability Limitation

To the maximum extent permitted by applicable law, FitlandHQ, its owners, directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our facilities or services. Our total liability to you shall not exceed the amount paid by you for your membership in the three months preceding any claim.

7. Intellectual Property

All content on our website and app — including text, graphics, logos, images, and software — is the property of FitlandHQ or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Mobile Application

By installing and using the FitlandHQ mobile application (available on Android and iOS), you agree to the following additional terms:

• Device Permissions: The app requests camera access to scan QR codes for member check-in and login. You may be prompted to grant this permission on first use. Denying camera permission will disable QR-based check-in; other features remain accessible.
• No Background Data: The app does not access your camera, microphone, or any device sensor when running in the background or when the QR scan screen is not active.
• App Updates: We may issue updates that add features, fix bugs, or address security vulnerabilities. Continued use after an update constitutes acceptance of any revised terms applicable to the new version.
• Account Deletion: You may request deletion of your account and all associated data at any time by emailing admin@fitlandhq.com. See our Privacy Policy for full details.
• Third-Party Platforms: Your use of the app is also subject to the terms of the platform through which you obtained it (Google Play Store or Apple App Store). We are solely responsible for the app and its content, not those platforms.

9. Privacy

Your use of our services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described therein.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nepal.
